[/caption]It was last year when there were reports of Toyota cars accelerating without the input from the drivers… supposedly evidence of an electrical problem with Toyota's electronic and breaking system.
Toyota went through a PR disaster, hearings on Capitol Hill, and concluded with the recall of some 8,000 of its' vehicles.
Business Week is reporting that Toyota's testing of its' vehicles show that almost all of the acceleration problems were due to human error. To be specific: pedal entrapment; sticky pedal; and pedal misapplication.
Toyota has looked at over some 2,000 reports to come to its' conclusion that human error was mostly the cause of the acceleration. they went to say that it has yet to find any electronic malfunction to blame for the alleged malfunctions.
Not everyone is buying the company's take on the results .
Joan Claybook, a spoke person for the advocacy group, Public Citizen, thinks that Toyota should focus on its cars electronic systems. She is intimating that Toyota has a monetary vested interest to find that it was not culpable in its vehicle acceleration.
Toyota might have help to support its findings; the NHTSA who investigated the Audi acceleration problem findings were similar to their own.
The stakes are high. Toyota is already facing over 325 law suits stemming from the alleged issue. As is the wont with litigation of this nature, all these cases, sooner or later, will be consolidated to form a class action law suit.
Whatever the current status of the litigation, the lawyers representing the various plaintiffs have not responded to Toyota’s findings, and I am certain that they will disagree wholeheartedly, because their experts will find a way to give credence to negligence on behalf of Toyota.
