Proposition 8, the controversial equality bill that bans same sex couples from receiving the right to marry in the state of California, is set to be ruled on today. But there is a certain amount of nervousness from supporters of the banning of gay marriage, who are trying to put a stay on the long-coming decision.
This attempt to stop the judge from ruling gives a clear indication of the mood of the public. Prop 8 is unlikely to be upheld, with wide support on a country-wide level. Most people in America believe in either a full marriage allowance, or at least the ability for legally recognized civil unions between gay couples, according to polls taken between 2006 and May of this year.
In the state of California, the support is especially high, with many high profile celebrities being open in their push for gay rights in the state, and their opposition of Prop 8.
Now Chief U.S. District Judge Vaughn Walker will be making a ruling on whether or not the law is unconstitutional, and it is most likely it will be found to be. With the same arguments having been used in the defense in laws against interracial marriage in earlier American history, many have drawn parallels between the two issues, and lawmakers have been under increasing pressure for a similar ruling.
Attorneys who support Prop 8 have officially asked for a stay on the ruling if it is found to have no constitutional basis, San Jose's Mercury News reports.
This last ditch attempt to protect the law seems to give credence to the possibility that it will be ruled in favor of gay marriage in the state, and most non-profit groups seems to agree.
The ruling will be released within the next few hours, and the stay in unlikely to be allowed, given the one sided argument of the filing.
